Trans director Sam Feder's recent documentary "Heightened Scrutiny" provides a powerful two-part viewpoint – simultaneously an intimate profile of a prominent transgender activist and a sharp analysis of media coverage surrounding trans rights.

Legal Battle at the Highest Court

This documentary follows ACLU attorney Chase Strangio as he gets ready for oral arguments in the landmark highest court case the Skirmetti case. These proceedings occurred in December 2024, with the court eventually ruling in support of the state's position, essentially enabling limitations on treatment for transgender young people to stay in place across over twenty US states.

We produced Heightened Scrutiny in just 16 months, explained Feder during a discussion. Meanwhile, my previous film Disclosure took me half a decade, so this was quite rushed. Our goal was to stimulate dialogue so people would know more about the case.

Personal Narrative Amid Political Struggle

Although Feder presents a thorough critique of how prominent news organizations have promoted anti-trans talking points, the film's primary contribution may be its engaging portrayal of Strangio. Usually a reserved attorney in public appearances, Strangio displays his authenticity throughout the production.

This represented a significant challenge, to share parts of my life to a documentary crew that I had worked hard to keep confidential, stated Strangio. Sam said he wanted the next generation to know that we tried, to see what was done in support of these struggles for our material survival.

Diverse Perspectives in the Movement

To enhance Strangio's account, Feder incorporates numerous transgender voices, such as well-known leaders from media and the arts. This film also includes perspectives from cisgender advocates who critique how established publications have participated to harmful coverage of trans individuals.

The perspective of trans minors key to the legal case is illustrated through a remarkable young student named Mila. Audiences initially witness her speaking out for her community at a educational meeting, with later moments showing her speaking for transgender rights outside the Supreme Court.

Intimate Moments Beyond the Courtroom

Heightened Scrutiny also includes touching moments where Feder moves beyond the never-ending legal struggle, such as scenes of Strangio vacationing in Italy and getting a tattoo featuring lines from civil rights leader Pauli Murray's poem "Prophecy."

This body art moment is one of my most cherished sections in the movie, stated Strangio. Being tattooed is almost like a contemplative experience for me, to be fully present in my body and to view it as a vessel for things that are significant to me.

Physical Autonomy and Portrayal

Feder's dedication to lovingly showing Strangio adding to his tattoo collection highlights that this film is primarily about transgender bodies – not only those of youth who face prohibition of their right to live truly in their own bodies, but also the bodies of the various interviewees who participate in the film.

I make films with a purpose, and part of that is picking people who are brilliant and concise enough to sustain the camera, shared Feder. Whenever people ask me what they should dress for an interview, my reply is anything that makes you feel confident. This is crucial to me – as trans people, we have difficulties so much with our appearance.

Impact and Optimism

One factor that makes Feder's documentaries excel is his clear skill for making his trans subjects feel respected, seen and valued. This approach fosters authentic rapport between Feder and Strangio, helping the director to accomplish his objective of presenting Strangio as a whole person and providing a document for posterity of how resiliently he and fellow activists have struggled for transgender rights.

I don't want people to end up in a place of constant hopelessness because of what the law is failing to provide us, stated Strangio. I strive to be in a process of using the law to reduce harm, but not to transform it into some kind of channel for our liberation aspirations. State bodies is not going to be the reflection through which we perceive ourselves. Our community are that mirror, and it's really vital that we continue having that dialogue in addition to discussions about resisting these regulations and procedures.
